Death row pit bull awaits VCAT ruling

A BANYULE dog owner is fighting a legal battle to save the animal from being destroyed under the state government's tough new dangerous dog laws.

Banyule City Council officers seized the unregistered dog after it was "found wandering at large" just after Christmas, spokesman Dave Bell said.

The dog was suspected of being an American pitbull terrier and impounded at the RSPCA in Burwood East under new state laws which ban pitbulls as restricted breeds.

The RSPCA supported the council officers' initial assessment.

The dog's owner, whose identity has not been made public, has appealed the decision at the Victorian Civil and Administrative Tribunal.

If VCAT upholds the council's decision the dog will be the first pitbull to be euthanised as a result of the law since an amnesty on registering a pitbull as a restricted breed ended in September.

Nine Banyule dogs were registered as restricted breeds before the amnesty ended. There were six in Darebin and seven in Whittlesea.

Municipal Council of Victoria chief executive Rob Spence said there was still some confusion about whether dogs registered as American staffordshire terriers had to have pedigree papers or else were assumed to be pitbulls.

Mr Spence said councils would have to pay the cost of impounding these dogs, as well as the costs of VCAT proceedings if owners appealed.

Banyule City Council spokeswoman Trish Hosking said a full hearing was scheduled for February 22. She said no further details could be given.

How sad to have to fight to keep your dog and family member because he is judged based on what he looks like. Agreed the dog should have been registerd in the first place, but we should be punishing the deed, not the breed. This law is racism at best. I and my dog (an American Bulldog) were attacked recently by 3 cattle dogs - they and their owner have not been punished. I have also been attacked by numerous other small dogs (they take exception to the size of my dog). Yet never have I been attacked by a bull breed dog such as a staffy or pitbull type, or by mastiffs or other 'malossar' types

What utter mad hatter organisation is VCAT. Does the dog know he maybe illegal so why kill the dog. They should be rehoming the dog even if it has to be shipped interstate where apparently sanity rules and jail the humans.

I have never heard such utter hysteria and mob lynching rubbish in all my life.

Where are the experts. This is a mob of drips under pressure. No dog should be killed because it has a "name".

This poor dog and owner. Did the dog actually do anything wrong?? This is just racist behavior pure and simple. JUDGE THE DEED NOT THE BREED. BSL does not work, how many dogs and owners will suffer before the government/councils realize this?
